NO PURCHASE NECESSARY TO ENTER OR WIN. Making a purchase will not increase your chances of winning. The CNN “Where Do You Watch Live” Contest and Sweepstakes ("Promotion") begins at 12:00:00 PM (Noon) Eastern Time ("ET") on Tuesday, November 4, 2008 and ends at 12:00:00 PM (Noon) ET on Tuesday, December 23, 2008 (“Promotion Period”). Void Outside the 50 United States and District of Columbia (“D.C.”) and where prohibited.
           

  1. ELIGIBILITY: The Promotion is open to legal residents of the 50 United States and D.C. who are 18 years of age or older at the time of entry. Employees, officers and directors of Cable News Network, Inc. (“Sponsor”), and RealTime Media, Inc. (together with Sponsor, ”Promotion Entities”), their respective parent companies, affiliates, subsidiaries, advertising, Promotional, fulfillment and marketing agencies, and members of the immediate families (parent, child, sibling & spouse) or households  (whether related or not) of any of the above are not eligible to participate in the Promotion. By entering the Promotion, participants agree to release, discharge and hold harmless Promotion Entities, their respective parent companies, affiliates, subsidiaries, retailers, agencies and the respective officers, directors, employees and agents of each of the foregoing, from and against any and all damages whether direct or indirect, which may be due to or arise out of participation in the Promotion, or in Promotion-related activities, or the acceptance, use/misuse or possession of any prizes that may be awarded to them. By participating, you agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. All federal, state and local laws and regulations apply.
  2. HOW TO ENTER THE PROMOTION:  The Promotion consists of a Contest and Sweepstakes component.

    A.
    The Contest: No purchase necessary to participate. LIMIT: Limit one Promotion entry per person/per email address per Video or Photo, with a maximum of 5 Video and/or Photo submissions per length of the Promotion.  Potential winners who are discovered during prize verification to have entered or attempted to enter more than once a day may be disqualified at the sole discretion of the judges. A total of five (5) Videos and/or Photos may be submitted by each entrant. Subsequent entries may result in disqualification of all submissions.

    The three (3) phases of this promotion are as follows:

    1) Phase 1: Call for Entry: The Contest Entry Phase begins at 12:00:00 PM (Noon) Eastern Time ("ET") on Tuesday, November 4, 2008 and ends at 12:00:00 PM (Noon) ET on Tuesday, December 2, 2008.

    To submit an entry into the Promotion, go to the following Web site address: www.wheredoyouwatchlive.com (the “Promotion Website”). Entrants will be asked to complete a registration form and must enter their true and correct information in all required fields.  Once all required fields are entered, click the “Continue” button to complete the registration process. Once registered, entrants will have the ability to submit a Video or Photo file to be entered into the Promotion. In addition users will be asked to enter a 140-character caption in a text box, to accompany the Video or Photo. (See “Entry Details” below).

    Entry Details:  
    Once registered, entrants can submit an entry into the Promotion by creating and uploading their own Video or Photo file and caption on the upload page of the Promotion Website. Beginning November 17, 2008 entrants can also submit a Video or Photo entry via email. Regardless of the type of entry, both Video and Photo entries MUST contain a caption of 140 characters or less for the submission to count.

    Video must be in .MOV or .WMV format. Video must be 15 seconds or less in length and must not exceed 2 MB in size. Photo must be in .JPG format and must not exceed 2 MB in size. Should entrants experience any difficulties with any aspect of the Where Do You Get Live, they may send an email to cnnwheredoyouwatchlive@promosupport.com. Requests will be answered promptly.

    Once the Video or Photo entry along with the required caption is submitted, entrants will be officially entered into the Promotion. Promotion entries cannot be revised or altered once submitted. Once submitted, all submitted components become the property of the Promotion Entities and will not be returned.  All accepted entries will be published, making them available on the map.

    Information regarding Submissions:
    The Promotion Entities shall have the right to disqualify any entries that they deem to be obscene, vulgar, sexually explicit, lewd, derogatory, inappropriate, or otherwise not in good taste, as determined by the Promotion Entities in their sole discretion.
    LICENSE: Entrant grants Promotion Entities and their designees the right, but not the obligation to edit, remove, modify, publish, license, print, transmit, display or otherwise use the Video or Photo Entry, the description, and all accompanying personally identifiable information entrant submits (collectively, the “Submission”), via all forms of media now known or hereafter devised (including on http://ireport.com/promochallenge), worldwide, in perpetuity, without notice to entrant and without compensation.
    WARRANTY: Entrant represents and warrants that (i) entrant’s Submission was taken by entrant, (ii) the Submission is original to entrant and does not infringe upon or otherwise violate any right of any third party, and (iii) entrant has all rights necessary to submit the Submission, including all necessary authorizations and permissions from any persons included in the Submission, (iv) that the Submission will not include unlawful, threatening, libelous, defamatory, obscene, pornographic or other material that would violate the law; or (iv) advertising for third party products or services.
    Video and Photo entries submitted in connection with this Promotion (a) must be intended for a family audience and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for a general audience; (b) must not, in the sole and unfettered discretion of the Sponsor, contain any nudity, sexually explicit, disparaging, libelous or other inappropriate content; (c) must not in the sole discretion of the Sponsor, contain any commercial content that promotes any product or service other than the Sponsor’s; (d) must not contain any trademarks, copyrighted works or other intellectual property. Any elements appearing in the Video or Photo Entry, including without limitation stills, clip art, supers, or other materials (collectively, “Elements”) used must be entirely original, created and performed by entrant, be in the public domain, or be an Authorized Assets. Use of any Elements or other materials that are not original to entrant, not in the public domain, or that are not an Authorized Asset may result in disqualification.
    All Submissions may be posted on the publicly accessible Promotion Web site during and following the Promotion Period. The Promotion Entities are not responsible for late, lost, illegible, incomplete, stolen, garbled or misdirected entries, all of which are void.

    2) Phase 2: Contest Judging: The Contest Judging Phase begins at 12:00:00 PM (Noon) Eastern Time ("ET") on Wednesday December 3 2008 and ends at 12:00:00 PM (Noon) ET on Tuesday, December 9, 2008.

    Entries must meet the following eligibility criteria:
    • Video must be in .MOV or .WMV format
    • Video must be 15 seconds or less in length and must not exceed 2 MB in size
    • Photo must be in .JPG format and must not exceed 2 MB in size
    • Appropriateness of entry to Contest Theme
    • Appropriateness of entry to CNN
    • Appropriateness of entry in General
    • Adherence to standards of compliance with regards to latest DMCA regulations
    • Correctness of entry to be validated by system and placed onto the map.

    The judges will select a total of ten (10) entrants as the finalists (“Semi-finalists”). Semi-finalists will advance to Public Voting. These submissions will be posted to the Promotion Website for the public to cast their vote for the most unique submission.

    3) Phase 3 Public Voting: The Public Voting begins at 12:00:00 PM (Noon) Eastern Time ("ET") on Wednesday, December 10, 2008 and ends at 12:00:00 (Noon) PM ET on Tuesday, December 23, 2008.  LIMIT: Limit one (1) vote per person or email address, per day.

    To submit a vote for the most unique entry, go to the following Web site address http://www.wheredoyouwatchlive.com and click on the link “Vote Now”. Participants will be required to register in order to vote. Once registered, participants will proceed to the Public Voting page and will be able to submit one (1) vote per day for the most unique Semi-Finalist entry.

    The Finalist who receives the highest number of public votes will be selected as the Grand Prize Winner (“Grand Prize Winner”) subject to verification of eligibility and compliance with the Official Rules.
    In the event of a tie at either Phase 2: The Initial Contest Judging Stage or Phase 3: The Public Voting Stage, the Submission which the Judges deem strong(est) in "Creativity" will be declared the potential Semi-Finalist or winner. Any further ties will be broken by the Submission which the Judges deem strongest in "Content/Story". The decisions of the judges are final.

    Any attempt by a person to use multiple email accounts to enter more than once may result in disqualification at the discretion of the Sponsor. Among other required information, entrants must enter a valid United States postal mailing address at the time of entry in order to participate.  PO Boxes are not acceptable, and entries containing a PO Box address will be disqualified. Entries will be deemed made by the authorized account holder of the email address submitted at time of entry. In the event of a dispute regarding the identity of any potential winner, the potential winner will be deemed to be the authorized account holder of the email address submitted at time of entry.  The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address.  A potential winner must provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the potentially winning Contest entry. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, illegible or corrupted are void and will not be accepted. By entering the Promotion, entrant recognizes and agrees that the entry information provided by entrant will be made available to Sponsor; use of such information will be governed by Sponsor’s privacy policy available at http://www.cnn.com/privacy.html.

    By entering the Promotion, entrants grant Sponsor the right to use and publish entrants’ proper name online in connection with the Promotion. The use of the entrant’s name online in connection with the Promotion does not signify that the entrant is a winner in the Promotion. By accepting a prize, each winner (or his/her parent or legal guardian if winner is 18 but deemed a minor in his/her state of residence) consents to the use of winner’s name, address, likeness and/or quotes attributable to winner for advertising and Contest purposes in all media worldwide without limitation or additional notice or compensation except where prohibited. 

    B. THE SWEEPSTAKES: No purchase necessary to participate.  Entrants will receive one (1) entry into the Sweepstakes to win an iPod Nano by Registering for the Contest and submitting an entry. Entrants will also receive an entry into the Sweepstakes to win a CNN t-shirt coupon each day they come back to vote during Phase 3 of the Contest. Subsequent entries from the same person and/or email address in the same day will be disqualified. For the purposes of the Sweepstakes, a day shall mean a 24 hour period, beginning at 12:00:00 AM ET and ending at 11:59:59 PM ET. Any attempt by a person to use multiple email accounts to enter more than once may result in disqualification at the discretion of the judges or Sponsor.

  3. Promotion Prizing:

    Contest Prize: At the conclusion of the Contest, the Finalist with the most votes will be selected as the Grand Prize Winner.

    Grand Prize: Slingbox Pro Approximate Retail Value (“ARV”) $299.

    Sweepstake Prizes:  There are a total of 42 Sweepstakes prizes. An electronic randomized drawing will be held each week by RealTime Media, Inc., an independent judging organization, to select twenty-eight (28) Winners who submitted entries during the Entry Period of the Contest starting on November 4, 2008 and ending on December 2, 2008.

    An additional electronic randomized drawing will be held on or about December 30, 2008 by RealTime Media, Inc., an independent judging organization, to select fourteen (14) Winners who submitted votes during the Voting Phase of the Contest. Odds of winning a prize depend on the number of eligible entries received.

    28 Nano (28):  Twenty-eight (28) Nanos will be awarded during the Entry Period of the Promotion. ARV is $199.

    14 CNN T-shirts (14): Fourteen CNN t-shirts coupons will be awarded at the end of the Voting Phase of the Promotion. ARV is $15.

    Specifics of all prizes are at the Sponsor’s sole discretion. Total ARV for all Prizes in this Promotion is $6,160.

  4. PRIZE AWARDING: Prizes will only be awarded upon winner verification and final approval of Sponsor and its designees. No prize substitution, cash equivalent of prizes, transfer or assignment of prize permitted, except by Sponsor in its sole discretion, or as otherwise provided herein. Sponsor reserves the right to award a prize or portion thereof of equal or greater value if any prize or portion thereof becomes unavailable. Potential Winners will receive notification that he/she has won via electronic mail, phone, and/or mail. Winners may each be required to execute an affidavit of eligibility, liability release, tax acknowledgment form and, except where prohibited by law, a publicity release and return within ten (10) business days of issuance of notification.  Noncompliance within this time period or failure of potential winner to respond after three (3) notification attempts may result in disqualification and, at Sponsor’s discretion; an alternate winner may be selected.  If the winner of any Promotion prize cannot be contacted; is ineligible; fails to properly claim the prize in accordance with these Official Rules; if the prize notification/prize is returned undeliverable; or if the winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and an alternate Winner will be chosen from among the remaining eligible entries.  Sponsor reserves the right to award only the number of prizes stated in Rule #3.

  5. DISQUALIFICATION:  Promotion Entities are not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures, destruction or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Promotion; (iv) any entries submitted in a manner that is not expressly allowed under these rules; or (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with utilized in the Promotion. All incomplete or non-conforming entries will be disqualified.  If for any reason this Promotion cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Promotion, or if this Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, or if fire, flood, explosion, war, embargo, government requirement, fraudulent, criminal or grossly negligent acts, security breaches, civil or military authority, terrorism, acts of God, acts or omissions of carriers, or any other cause beyond Sponsor’s control, interferes with the Promotion proper conduct as contemplated by these Official Rules, as determined by Sponsor in its sole discretion, the Sponsor, may, without prior notice, terminate, modify or suspend the Promotion, in whole or in part.  If this Promotion is terminated before the original end date, Sponsor will award the Prizes by random drawing from among all eligible, non-suspect entries received as of the termination date/time. In the event of termination of the Promotion, Sponsor will post notice regarding the termination on the website.  Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or who enters using any automatic or programmed entry duplication method.

    The Promotion Entities do not assume any responsibility for any disruption in the Promotion caused by circumstance or other unforeseen events outside of the control of the Promotion Entities. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Promotion materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.

  6. TAX INFORMATION: All federal, state, local, and other income taxes on prizes are the sole responsibility of the applicable winner, and each winner may be issued an IRS Form 1099 for the value of his/her prize.

  7. GENERAL INFORMATION: This Promotion is conducted in English (which will be given its everyday ordinary meaning), and any and all disputes will be resolved in the appropriate courts in the Commonwealth of Pennsylvania, exclusively, and subject to the laws of the Commonwealth of Pennsylvania. Should there be a conflict between the laws of the Commonwealth of Pennsylvania and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Pennsylvania.  Entrants irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-conveniens or lack of personal jurisdiction they may have.

  8. WINNERS LIST: To receive a list of winners, send a #10 self-addressed stamped envelope for receipt by January 30, 2009 to: The Where Do You Watch Live Contest and Sweepstakes Winners List Request, 1060 First Avenue, Suite 201, King of Prussia, PA 19406.
